QUEUE POLICY

i update this live and highly recommend for commissioners to bookmark this page to see the progress of my work.commissions booked through a reservation and commissions with rush fees are given priority in my queue. this may cause regularly booked commissions to be pushed further back in the queue.

payment information

> all transactions will be done over ko-fi. all correspondences will be made through direct messages on instagram, threads, or through e-mail (linked in the PLATFORMS section).> i primarily accept 100% payment upfront. payment plans may be made available in limited slots on a first come, first served basis. this helps me maintain my monthly income goal, as most of my commissions take more than a month to complete.> if the commissioner chooses to terminate a project after work has begun, refunds will be issued based on the stage of completion: commissions that have reached the coloring stage are eligible for a 25% refund of the full commission price, while commissions with only the sketch completed are eligible for a 50-75% refund.> repeated refund requests from the same client may result in me declining future commissions after the second occurrence.

rush fees

> if you need your commission completed sooner, you may request a rush order for an additional fee calculated based on how much of the standard turnaround time (detailed on my prices page) is being removed.

> a rush fee does not guarantee completion by a specific date unless a deadline has been explicitly agreed upon between us in writing.

anti-ai policy

> references provided for a commission must not be generated by generative ai.> do not commission me on behalf of an ai user or ai-generated project. i reserve the right to refuse or discontinue business with clients whose work, marketing, or publishing practices involve generative ai.> clients with a history of using generative ai may still inquire provided that they have fully discontinued their use of generative ai and no longer profit from or distribute ai-generated work. this exemption is intended for clients who are actively transitioning away from generative ai and wish to work exclusively with human artists going forward.> upon request, i can provide examples such as full speedpaints and working files containing layer information as additional assurance that all my artwork is created without the involvement of generative ai.> clients may also provide their own contract or agreement requiring that i do not use generative ai in the creation of their commissioned work. i am happy to review and sign reasonable agreements of this kind before beginning a commission.

USAGE RIGHTS

> if a commissioner intends to use the commissioned artwork for commercial, promotional, advertising, merchandise, branding, publishing, or other profit-generating purposes, they must disclose this before the commission is confirmed.> additional usage rights may require additional payment to be processed separate from the commission depending on the intended use. refer to the usage fees section for more information.> in cases where the commissioner is interested in additional commercial usage after a personal use commission is completed, please contact me to purchase a commission use license.

general notes

> i reserve the right to decline a commission for any reason.> i reserve the right to post the commissioned artwork to my social media at any time in any form.> i will allow one free round of revisions for each stage of the commission (sketch, colors, final render). any further revisions will require additional payment based on the level of detail.> the commissioner will be given two weeks to send revision notes to me. if no notes are given within this period, i will proceed to the next stage or consider the commission completed if it's in the final render stage.> if the commissioner heavily changes the brief after the payment stage, i may require additional payment. i may refuse to carry out changes which substantially change the nature of the commission.> the commissioner shall ensure the illustrator is visibly credited in any editorial, promotional, and personal use of the artwork, either using my full name "Nikolai Espera" or my social media handles ("nikespera", "nikespera.png").> do not alter the artwork without my consent. do not reproduce my art commercially if you do not have a license. do not use it for nfts.> do not feed my artwork into generative ai. this includes uploading, processing, prompting, training, editing, upscaling, or otherwise submitting my work to ai systems.> if i discover that a client has knowingly violated any of the terms expressed on this page, especially from my anti-ai policy, i reserve the right to immediately terminate our business relationship and revoke any licenses or permissions granted for the use of my artwork. any continued use of my artwork following such revocation will constitute as unauthorized use. in the event of termination mid-project due to this clause, all payments already made will be fully retained as a non-refundable cancellation fee to compensate for the time reserved, work undertaken, or loss of a commission slot resulting from the client's violation.
